Key things to know
- Your photos are yours. We don't sell them, we don't show them to anyone you haven't invited, and we don't train anything on them.
- You can take everything out at once, any time. Export is one button, and it's free.
- Nothing here takes away your rights under the Australian Consumer Law.
- If we change these terms, the change starts 30 days after we post it.
1. Who we are
dayfrom is run by Brice Lechatellier (ABN 60 682 103 881), a sole trader in New South Wales, Australia. When we say we, us or our, that's who we mean. You can reach us at hello@dayfrom.com.
2. Using dayfrom
You need an invitation. There's no public sign-up, and there's no password. A six-digit code, once per device, is the whole of signing in.
You need to be 18 or over to hold an account. Children appear in a journal because a parent put them there, and a parent exercises their rights until they're old enough to do it themselves.
3. Your content
You own the photos, the videos and the words you put in. That doesn't change because they're sitting on our disks.
You give us permission to store them, and to show them to the people you invited. That's the whole licence. We don't sub-license it, we don't hand it on if the company is sold, and we don't use your family's content to advertise anything or to train a model.
If we ever want to do something with your content this section doesn't cover, we'll ask you first. Not in an update to these terms.
4. Closing your account
You can close your account from settings. Here's what happens, and when.

Export first if you want any of it. The export is a .zip of your original files, at full resolution, with nothing recompressed.
5. If we close your account
We can suspend or close an account if you breach these terms and don't fix it within 14 days, if the breach is serious, or if we suspect fraud or something illegal.
We'll tell you why, and you'll have 30 days to export before anything is deleted.
6. Limits on our liability
Nothing in these terms overrides your rights under the Australian Consumer Law or any other protection you have by law.
Apart from those rights, our total liability to you is capped at what you've paid us in the 12 months before the problem arose, or $1,000, whichever is lower.
7. Changes to these terms
We'll post the change here and it takes effect 30 days later. Carrying on using dayfrom after that means you accept it. If you'd rather not, export everything and close your account.
8. Other legal bits
These terms are governed by the law of New South Wales, and disputes go to the courts of New South Wales.
If something goes wrong, email us first. If that doesn't settle it, we'll go to mediation through the Australian Disputes Centre before anyone goes to court.
